Terms and Conditions
Terms and Conditions of Sale
These Terms will apply to any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any Products from our site. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Products from our site.
You should print a copy of these Terms or save them to your computer for future reference.
We amend these Terms from time to time as set out in clause 16. Every time you wish to order our Products, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 11 January 2016.
These Terms, and any Contract between us, are only in the English language.
1. Information about us
1.1 We operate the website www.london-victorian-ring.com. We are a partnership trading from 100 Hatton Garden, at The London Diamond Bourse, London, EC1N 8NX. Our VAT number is GB 230 9468 62.
1.2 To contact us, please see our Contact page.
2. Our Products
2.1 The images of the Products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflect the colour of the Products. Your Products may vary slightly from those images.
2.2 All Products shown on our site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will refund your order if made.
2.3 Within our Product range we also manufacture Bespoke Jewellery, please see the ‘Bespoke Jewellery’ section below for the specific terms applicable to those items.
3. How the contract is formed between you and us
3.1 Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the order process.
3.2 After you place an order, you will receive an e-mail from us acknowledging that we have received your order. This does not mean that your order has been accepted.
3.3 We will confirm our acceptance to you by sending you an e-mail that confirms that the Products have been dispatched (Dispatch Confirmation). The Contract between us will only be formed when we send you the Dispatch Confirmation.
3.4 If we are unable to supply you with a Product, we will inform you of this by e-mail and we will refund your order. We may be able to offer a similar type of jewellery to the piece originally ordered but you will not be under any obligation to order any items we suggest.
4. Price of Products
4.1 The prices of the Products will be as quoted on our site from time to time. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system.
4.2 Prices for our Products may change from time to time, but changes will not affect any order which we have confirmed with a Dispatch Confirmation.
4.3 The price of a Product includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect.
4.4 Our site contains a large number of Products. It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. If we discover an error in the price of the Products you have ordered we will contact you by email to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you by email. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price.
5. How to pay
5.1 You can pay for Products using a debit card, credit card, PayPal, bank transfer or interest free finance option. We accept the following cards: Visa, MasterCard, American Express, Visa Debit, Electron and Maestro.
5.2 Payment for the Products and all applicable delivery charges is in advance.
5.3 Payment by bank transfer. If a bank transfer is not received in three working days from receipt of the confirmation of the order the item will be placed back in stock. On placing the order by a bank transfer an e-mail will be sent with details to make the transfer.
6. Delivery or Collection
6.1 Your order will be fulfilled by the estimated delivery date set out in the Dispatch Confirmation, unless there is an Event Outside Our Control. If we are unable to meet the estimated delivery date because of an Event Outside Our Control, we will contact you with a revised estimated delivery date.
6.2 Delivery will be completed when our courier company delivers the Products to the address you gave us. The Products will be your responsibility from the completion of delivery. We will deliver to the address to which your payment card is registered (your Billing Address) unless you select an alternative address. For restrictions of alternative delivery addresses please see the ‘Alternative Delivery Address’ section below.
6.3 Please see our Delivery page for further information on the delivery system we use, timescales for delivery and the insurance we have in place to protect your items during transit.
6.4 You can choose to collect your ring in person when you have ordered your ring on-line. Please contact us to arrange an appointment time by telephone on 020 7193 4412 or by e-mail at email@example.com. The person who purchased the ring must be the same person who collects the item. Only items under £2,000 can be collected in person when ordered on-line unless there has been a prior agreement in writing. In order to safeguard your payment card against fraud, you will need to bring:
- The transaction receipt
- The same payment card used to purchase the item
- A recent utility bill to confirm your address, which must be the same address used for the card transaction.
- A driving licence or passport
For security reasons, we are only allowed to release the item with these forms of identification when you have ordered your ring on-line and are collecting in person.
We can make appointments Monday to Friday between 9.30am and 5.30pm.
6.5 If you wish to check that your order can be ready for delivery or collection by a certain date, please call us on 020 7193 4412 or email firstname.lastname@example.org before ordering and we will let you know whether we are able to meet your request. We will always try to accommodate a tight timeframe. Please note however that failure to meet an agreed date will not affect your contract with us.
6.6 You own the Products once they have been delivered to you, provided that payment for the Products has been made in full.
7. Alternative Delivery Address
7.1 You may prefer for us to deliver to an address other than where your payment card is registered. You will be able to enter a different address at the ‘Checkout’. We will ask for further confirmation of identify and proof of your link to that alternative address to enable us to securely deliver your parcel.
7.2 Please note, we cannot guarantee items can be sent to an alternative address without appropriate security checks. This is to prevent fraudulent use of your card and to ensure the safe arrival of your parcel. Please contact us either by telephone or e-mail, in advance, if you would like to confirm it is possible to have the item delivered to an alternative delivery address.
7.3 Your payment card company may be able to add another address to your card. Please telephone your credit card company to ask if this is possible. Once the other address is added, you will be able to enter the Billing Address and alternative delivery address as the same during the checkout process.
8. International Delivery
8.1 We deliver to various countries throughout the world (International Delivery Destinations). Please see our International Orders page for more details on the International Delivery Destinations available and for likely timescales for delivery. International delivery charges are specified at the checkout.
8.2 If you wish to check if delivery can be made before a certain date please call us on 020 7193 4412 or email email@example.com before ordering and we will let you know whether we are able to deliver by that date. We will always try to accommodate a tight delivery timeframe. Please note however that failure to deliver by an agreed date will not affect your contract with us.
8.3 If you order Products from our site for delivery to one of the International Delivery Destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. Please note that we have no control over these charges and we cannot predict their amount.
8.4 You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.
8.5 Please note that we operate under the VAT Retail Export Scheme, otherwise known as the Tax Free Shopping Scheme. Please see here for further details.
8.6 You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such law.
9.1 As a consumer, you have a legal right to cancel a Contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the period set out below in clause 10.2. This means that during the relevant period if you change your mind or for any other reason you decide you do not want to keep a Product you can notify us of your decision to cancel the Contract and receive a refund.
9.2 Your legal right to cancel a Contract starts from the date of the Dispatch Confirmation, which is when the Contract between us is formed and ends 30 days after the day on which you receive the Product.
9.3 To cancel a Contract, you just need to let us know that you have decided to cancel within the timeframe stated above. The easiest way to do this is to e-mail us at firstname.lastname@example.org. We will e-mail you to confirm we have received your cancellation. You have a legal obligation to take reasonable care of the Products while they are in your possession.
9.4 Responsibility for the costs for the return of products will be payable by the customer. Items must be returned securely packed and insured during transit. For information about how to return a Product, please contact us by e-mail on email@example.com
9.5 If you cancel your Contract we will:
9.5.1 refund you the price you paid for the Products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
9.5.2 we will make any refunds due to you within 14 days or as soon as possible on the same payment card used for purchase.
9.6 If the Product you ordered has a GIA certificate you must ensure that the certificate is returned with the Product. Failure to return the GIA Certificate will incur a charge of £120 and we reserve the right to deduct this sum from any amount due to you.
9.7 Advice about your legal right to cancel the Contract under these regulations is available from your local Citizens' Advice Bureau or Trading Standards office. This cancellation right does not apply in the case of Bespoke and Custom Made Pieces.
10. Bespoke and Custom made pieces
10.1 Please note that if you are ordering Bespoke Jewellery and a term in this section conflicts with any other provision in these Terms, then the terms in this section apply.
10.2 Bespoke and Custom Jewellery are pieces made to your specifications. These include personalised engraving, bespoke jewellery designs, changes to an existing design and items with the diamond or other gemstone you have selected at an appointment, by e-mail or by telephone.
10.3 Bespoke and Custom Jewellery is not available to purchase directly from the e-commerce website. We will provide a secure payment option especially for your bespoke or custom purchase.
10.4 Bespoke Jewellery can take between one to four weeks to make depending on the setting, gemstone requirements and complexity of the design.
10.5 When dealing with Bespoke Jewellery we will confirm the delivery timescales with you in advance of taking payment and will do so either by e-mail or during your appointment.
10.6 Once the price and timescale has been agreed by you we will ask for a deposit of 33 %. The balance will be payable on collection where collection is made by you in person. If you wish the item to be delivered to you, you must pay the balance before delivery can be arranged. Please see the Delivery section of these terms for more information.
10.7 Once we have received the deposit from you a Contract will have formed.
10.8 Our Bespoke and Custom Jewellery pieces are not covered by our 30 day ‘no quibble’ policy. If for any reason you wish to cancel an order for Bespoke Jewellery you should contact us immediately, we may be able to cancel your order and charge cost price, but this will not be appropriate in all circumstances and you may still be charged the full price. Certain items may be returnable but this will be assessed on a case by case basis and at our absolute discretion.
10.9 Please note that the consumer right to cancel a contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (as referred to in detail in the ‘Your Right of Return and Refund’ section above) does not apply to Bespoke and Custom Jewellery.
10.10 Please note that our warranty will apply to our Bespoke and Custom Jewellery unless the specifications required by you are such that we feel we would not be able to give the warranty. We will advise you throughout the design process if any of your specifications will mean you will not receive the warranty in respect of the item in question and will suggest alternative designs where possible. If you wish to proceed without the warranty we will require confirmation of your wishes in writing.
11. Resizing and Repairs
11.1 Our website enables you to pre-select a ring size. If you do not know the ring size required you should tick the ‘I don’t know’ option. When selecting ‘I do not know’ the ring is made in an average size, and can be re-sized free of charge the first time. If you have pre-selected a ring size and the ring subsequently needs adjusting there is a charge of £42 plus £12 postage and insurance in transit.
Please note re-sizing of ‘Engraved Rings’ (which, for the avoidance of doubt are Bespoke Jewellery pieces – please see the Bespoke and Custom Made Jewellery section of these Terms) may not be possible if the ring size is pre-selected. Please contact us prior to placing your order to confirm you are ordering the correct size.
11.2 We are here to help you in the event of any accidental damage that affects any jewellery purchased from us. We can usually repair minor accidental damage with a minimal charge within a short timeframe. All repairs are done by us. If you would like to discuss a repair in more detail or obtain a quote for a repair please contact us on +44(0)20 793 4412 or firstname.lastname@example.org. Please note that our liability in respect of any repair is limited as set out in these Terms and no warranty is offered on any repair.
12. Manufacturing Warranty
12.1 Your new item of jewellery should last a lifetime and be a treasured and cherished heirloom to pass down through generations of your family.
12.2 We are confident in the quality of the workmanship of all of our Products, including our Bespoke and Custom Jewellery. Each item goes through a number of vigorous quality checks utilising the highest standard of skill and care. For peace of mind, we offer a life time manufacturing warranty to allow for manufacturing faults.
12.3 If you think there is a manufacturing fault with a Product purchased from us please contact us so that we can arrange to inspect the Product. If there is a manufacturing fault we will repair or replace the item without charge.
12.4 Our warranty applies to manufacturing faults only and excludes any other fault or damage, including but not limited to excessive wear and tear and physical damage whether accidental or otherwise. The warranty does not cover loss of gemstones. If another jeweller or third party has altered or re-sized the item the warranty will not apply and the item will be non-refundable.
13. Our liability
13.1 Any Product we supply to you will be of satisfactory quality. If they are not you should contact us for a repair or replacement. If we are unable to repair or replace the Product we will offer you a refund.
13.2 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the Contract.
13.3 We only supply the Products for domestic and private use. You agree not to use the product for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
14. Events outside our control
14.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause 14.2.
14.2 An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
14.3 If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:
14.3.1 we will contact you as soon as reasonably possible to notify you; and
14.3.2 our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
15. Communications between us
15.1 When we refer, in these Terms, to "in writing", this will include e-mail.
15.2 You may cancel a Contract by acting in accordance with clause 10. If you wish to contact us for any other reason, you can contact us on +44(0)207 193 4412 or email@example.com or by pre-paid post to The London Victorian Ring Co, 100 Hatton Garden, at The London Diamond Bourse, London, EC1N 8NX. If we have to contact you, we may do so by telephone, e-mail or by pre-paid post to the address you provide to us in your order.
16. Our right to vary these terms
16.1 We may revise these Terms from time to time to, among other things, reflect changes in how we accept payment from you and changes in relevant laws and regulatory requirements.
16.2 Every time you order Products from us, the Terms in force at that time will apply to the Contract between you and us. We recommend that you revisit this page regularly to check whether any changes have been made by checking the date on which they were most recently updated (see above).
17. Other important terms
17.1 You may only purchase Products from our site if you are at least 18 years old.
17.2 As a consumer, you have legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.
17.3 We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.
17.4 You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
17.5 This contract is between you and us. No other person shall have any rights to enforce any of its terms.
17.6 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
17.7 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.
17.8 Please note that these Terms are governed by English law. This means a Contract for the purchase of Products through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction.
